Know Your Rights When it Comes to The Workplace

February 18, 2020

People depend on their jobs for their livelihood, and many spend majority of their time each week in a workplace setting. Discrimination can make the workplace environment toxic for an individual, affecting his or her attendance and job performance. If you’re a victim, you may not know where to turn. You may fear retaliation or embarrassment from your employer if you confront them, making a bad situation worse.

At the office of Walter J. Pink & Associates, PC, our team of highly skilled and experienced attorneys can advocate on your behalf if you have suffered from workplace harassment or discrimination. Further, we will also advocate for employees who have been the victim of retaliation when they complain about workplace harassment or discrimination.

Employees have certain rights, such as the right to not be discriminated against, the right to be paid in accordance with the law, and the right to take leave for family and medical reasons. While federal employment laws have set the standard, many states have implemented workplace laws that provide additional protection for employees.

Common workplace employee grievances:

  • Discrimination: Employees and even prospective employees may not be discriminated against for certain characteristics, such as gender, race, disability, age, religion, and national origin.
  • Sexual Harassment: Harassment occurs when inappropriate sexual behavior prevents the victim from doing his or her job.
  • Wages and Hours: Your employer is legally obligated to pay at least the minimum wage, pay overtime when hours exceed 40 per week, and abide by other wage and hour laws.
  • Wrongful Termination: Employers may not fire you out of retaliation for a legal complaint or for protected characteristics (such as race, gender, pregnancy, etc.).

If you have been sexually harassed, discriminated or retaliated against at work, time is a key factor and you may lose your opportunity to file a claim if you wait. At the office of Walter J.
